The reform of the de minimis clause pursuant to Article 131-bis of the Italian Criminal Code finds its place within the legislative framework focused on reparation, outlined by Legislative Decree No. 150/2022 (the so-called Cartabia Bill). The latter has included the offender’s conduct subsequent to the perpetration of the crime among the criteria for assessing the (minimal) seriousness of the offence. This represents the most meaningful innovation of the provision, considering that, prior to the reform, post factum conduct was relevant solely as a sentencing factor. By contrast, case law generally overlooked subjective components in the application of Article 131-bis of the Criminal Code. This paper aims to examine the implications of the legislative intervention, focusing in particular on the (new?) nature and teleological perspective of the conduct subsequent to the offence, once connected to the de minimis clause. The analysis – which will also take into account the early case law on the new version of the provision – ultimately seeks to highlight the consequences of evaluating reparative conduct within the framework of the current wording of Article 131-bis of the Criminal Code. Such an approach would be consistent with the pressing need to realign the punitive system with the fundamental principle of extrema ratio in criminal sanctions and the social reintegration of the offender.

Abstract
Such an approach would be consistent with the pressing need to realign the punitive system with the fundamental principle of extrema ratio in criminal sanctions and the social reintegration of the offender.| File | Dimensione | Formato | |
