La liberazione del servus compeditus: Labeone e Quinto

D. 4, 3, 7, 7 (Ulp. 11 ad ed.) highlights the presence of different jurisprudential orientations regarding the case of the man who had freed the others’ servus compeditus. In fact, while Labeo wondered if the actio de dolo should be granted, a certain Quintus, an unidentified jurist, proposed the alternative between the action of theft and an action in factum. Especially this second opinion, focused on the motive of misericordia, presents aspects worthy of further study. D. 4, 3, 7, 7 (Ulp. 11 ad ed.) evidenzia la presenza di diversi orientamenti giurisprudenziali riguardo al caso di colui che avesse liberato l’altrui servus compeditus. Infatti, mentre Labeone si domandava se si dovesse concedere l’actio de dolo, un certo Quinto, giurista non identificato, proponeva l’alternativa tra l’azione di furto e un’azione in factum. Specialmente questa seconda opinione, incentrata sul movente della misericordia, presenta aspetti meritevoli di ulteriore approfondimento.
