In the latter part of the nineteenth century a new science of criminology (criminal anthropology and criminal sociology) has been developed in a constant comparison between Europe and America. The main technical topic concerning criminology was the individualization of punishment. European criminalists’ approach was mainly scientific: the most important study on this subject was L’individualisation de la péine, written in 1898 by the French jurist Raymond Saleilles and translated into English in 1908, where the author distinguished three kind of individualization: the legal, the judicial and the administrative one. Whereas, the American approach to the same problem was essentially pragmatic, and the European theories were realized in prison or criminal procedure reforms, as the indeterminate sentence, the suspension of sentence with probation or parole and the juvenile courts.
