The focus of the article is on the Green paper on Mortgage Lending the European Commission presented early 2005, following a wide consultation of both consumers' and banks' representatives. The article shows the many implications such a regulatory attempt could bring on mortgage contract law and stresses - by comparing the European and the American situation- the consequences an indiscriminate opening of the mortgage credit market could have in Europe too. Finally, the article suggests some issues a forthcoming Directive on that subject should address.
