This article examines the dissolution of municipal councils for mafia infiltration (Articles 143 ff. of the Italian Consolidated Local Government Act) through the lens of the doctrine of substitutive powers. Starting from the measure's particularly intense impact on local autonomy and on the democratic-representative circuit, and from the premise that the difference between partial substitution of activity and total substitution of the elected body is quantitative rather than ontological, the study argues that dissolution should be characterised as an extraordinary form of active administration falling within the category of substitutive powers, rather than as supervision over local bodies in the proper sense. On this basis, and following the "overall" assessment of the institute called for by Constitutional Court judgment no. 195/2019, the article analyses the statutory requirements for dissolution, its preventive purpose, the breadth of administrative discretion and the intensity of judicial review. It highlights the critical features emerging in administrative practice: the objectivisation of the evidentiary elements, the broadening of the objective requirement, the weakening of the causal link between mafia proximity and administrative dysfunction, and the risk that dissolution becomes a response to maladministration as such - an institute whose punitive nature is denied in principle while its typical effects are reproduced in practice. The article therefore proposes to bring the institute back within the constitutional framework of substitutive powers, giving full weight to substantive legality, proportionality and its character as a measure of last resort; and, de iure condendo, to flank it - critically revisiting the "third way" of paragraph 7-bis - with a less intrusive intermediate measure based on the same statutory requirements, so as to make dissolution genuinely residual and to require particularly stringent reasoning whenever it is used.
Il contributo analizza lo scioglimento dei consigli comunali per infiltrazioni mafiose, disciplinato dagli artt. 143 ss. TUEL, alla luce della dogmatica del potere sostitutivo. Muovendo dall'incidenza particolarmente intensa della misura sull'autonomia degli enti locali e sul circuito democratico-rappresentativo, e dalla premessa che tra sostituzione parziale di attività e sostituzione totale di organo corra una differenza quantitativa e non ontologica, lo studio ne propone una qualificazione come forma straordinaria di amministrazione attiva, riconducibile alla categoria dei poteri sostitutivi, piuttosto che alla funzione di controllo in senso proprio. Su tali premesse, e nel solco della considerazione «di insieme» dell'istituto sollecitata da Corte cost. n. 195/2019, vengono esaminati i presupposti dello scioglimento, la sua finalità preventiva, l'ampiezza della discrezionalità amministrativa e l'intensità del sindacato giurisdizionale. L'analisi evidenzia alcune criticità emerse nella prassi applicativa, con particolare riguardo alla progressiva oggettivizzazione degli elementi indiziari, alla dilatazione del presupposto oggettivo, all'attenuazione del nesso tra contiguità mafiosa e disordine amministrativo e al rischio che lo scioglimento si trasformi in uno strumento di reazione alla cattiva amministrazione in quanto tale, di cui si nega la natura sanzionatoria in linea di principio ma se ne riproducono in concreto gli effetti tipici. In questa prospettiva, il contributo propone di ricondurre l'istituto allo statuto costituzionale del potere sostitutivo, valorizzando i principi di legalità sostanziale e proporzionalità e il carattere di extrema ratio della misura. In chiave di riforma, viene infine prospettata — recuperando criticamente la «terza via» del comma 7-bis — una misura intermedia e meno incisiva fondata sui medesimi presupposti dello scioglimento, idonea a conferire a quest'ultimo un ruolo effettivamente residuale e a imporre una motivazione particolarmente stringente quando l'autorità ritenga necessario ricorrere alla misura dissolutoria.
