La nota esamina la sentenza n. 10 del 2025, che ha dichiarato l'inammissibilità del referendum sulla legge n. 86 del 2024.
With ruling no. 10 of 2025, the Italian Constitutional Court declared the referendum on differentiated regionalism inadmissible, basing its deci sion on the lack of clarity of the proposal following the declaration of un constitutionality of numerous provisions of Law no. 86 of 2024. This paper therefore aims to analyze the relationship between ruling no. 192 of 2024, the order of the Central Office for Referendums, and the ruling in question, in order to demonstrate how the referendum initiative – already devoid of meaning at that point – should have been declared unenforceable by the latter body.

Abstract
With ruling no. 10 of 2025, the Italian Constitutional Court declared the referendum on differentiated regionalism inadmissible, basing its deci sion on the lack of clarity of the proposal following the declaration of un constitutionality of numerous provisions of Law no. 86 of 2024. This paper therefore aims to analyze the relationship between ruling no. 192 of 2024, the order of the Central Office for Referendums, and the ruling in question, in order to demonstrate how the referendum initiative – already devoid of meaning at that point – should have been declared unenforceable by the latter body.I documenti in SFERA sono protetti da copyright e tutti i diritti sono riservati, salvo diversa indicazione.
