The questions that drive the entire study can be summarised in these terms: international context and EU law impact on the governance of Italian territory? And if so, in what ways and with what effects? In order to answer these questions, the aim of the paper, without unjustifiably exaggerating the effects of certain processes, is to conduct, as far as possible, a careful and disenchanted analysis of phenomena that are appearing in a phase of strong transition, marked by the use of new legal instruments and the affirmation of new factual elements that are becoming increasingly central to land care and management. Therefore, also in keeping with this statement, the aim will not be to offer a complete reconstruction of the general institutions of administrative law applied to the Italian land use governance (organisation, activities, subjective situations, protections) but, after distinguishing “what is” from “what should be” (following the approach suggested by the Is- ought problem), we will try to bring out the topicality or, on the contrary, the need for a rethinking of these categories, in the light of the necessary respect for any principles and the pursuit of any objectives set at supranational level. These criteria are also reflected in the approach of the paper, which does not follow the classic descending approach, but is composed of a Part One, in which an attempt is made to clarify what land governance and the administrative action in charge of it are today, in the light of the development of case law and the domestic regulatory framework, of a Part Two in which an attempt is made to identify and summarise the main points of influence and contact between the supranational discipline and the subject of Italian land governance, and of a Part Three in which an attempt is made to highlight some further practical reflections of the scenario that has emerged previously, in order to try in some way to formulate some regulatory proposals capable of tending towards the highest possible legal consistency in the subject under analysis.

Gli interrogativi che muovono l’intero studio si possono riassumere in questi termini: il contesto internazionale e il diritto dell’Unione europea impattano, in qualche maniera, sul governo del territorio italiano? E se sì, con quali modalità e con quali effetti? Per rispondere a questi quesiti, nell’elaborato, senza ingigantire ingiustificatamente gli effetti di determinati processi, ci si prefigge di condurre, nei limiti del possibile, un’analisi attenta e disincantata di fenomeni che si appalesano in una fase di forte transizione, contrassegnata dall’utilizzo di nuovi strumenti giuridici e dall’affermazione di nuovi elementi fattuali che divengono sempre più centrali nella cura e gestione del territorio. Dunque, anche in coerenza con questa affermazione, non si punta ad offrire una ricostruzione completa degli istituti generali del diritto amministrativo applicati al governo del territorio italiano (organizzazione, attività, situazioni soggettive, tutele) ma, dopo aver distinto “ciò che è” da “ciò che dovrebbe essere” (seguendo l’approccio suggerito dall’Is– ought problem), si prova a far emergere l’attualità o, al contrario, l’esigenza di un ripensamento, di queste categorie, alla luce del necessario rispetto di eventuali principi e del perseguimento di eventuali obiettivi fissati al livello sovranazionale. A tali criteri risponde anche l’impostazione dell’elaborato, il quale non segue la classica impostazione discendente, ma si compone di una Parte Prima, ove si cerca di chiarire cosa sono oggi il governo del territorio e l’azione amministrativa preposta, alla luce dello sviluppo giurisprudenziale e del quadro normativo interno, di una Parte Seconda in cui si provano ad individuare e riassumere i principali punti di influenza e di contatto tra la disciplina sovranazionale e la materia del governo del territorio italiana e di una Parte Terza in cui si tenta di porre in luce alcuni ulteriori riflessi pratici dello scenario emerso precedentemente, per provare in qualche modo a formulare alcune proposte regolative capaci di tendere alla più alta coerenza giuridica possibile nella materia in analisi.
