This chapter discusses international rules on the exercise of adjudicatory jurisdiction for crimes at sea and their implementation in Italy. It addresses recent domestic case law which, while purporting to comply with international obligations, is not always fully convincing in this regard; it further questions the adequacy of the domestic legal framework to effectively combating illicit trafficking in the Mediter- ranean Sea, considering the possible role of the Legislature and the Government in developing a more coherent and effective approach to the fight against impunity in that specific context.

Abstract

This chapter discusses international rules on the exercise of adjudicatory jurisdiction for crimes at sea and their implementation in Italy. It addresses recent domestic case law which, while purporting to comply with international obligations, is not always fully convincing in this regard; it further questions the adequacy of the domestic legal framework to effectively combating illicit trafficking in the Mediter- ranean Sea, considering the possible role of the Legislature and the Government in developing a more coherent and effective approach to the fight against impunity in that specific context.
