Legislative Decree No. 26 of 7 March 2023, in order to implement EU Directive 2019/2161, amended Article 37-bis of the Consumer Code, in- troducing in Italian Legal system public enforcement measures for the provisions of the consumer code transposing Directive 93/13/EEC. Within the framework of administrative proceedings attributed to the exclusive jurisdiction of the Competition and Market Authority, the latter may adopt - against professionals who use general terms and conditions containing unfair and/or non-transparent clauses to regulate the contractual relations they establish with consumers - injunctions, administrative pecuniary sanctions and further restorative measures, and may further accept commitments from the professionals. The essay addresses the many interpretative and applicative questions raised by the new provisions of the consumer code, investigating their overall impact on Italian Law on consumer contracts and dealing with the issue of the relationships between the administrative proceedings regulated by Article 37-bis of the Consumer Code and the civil (individual and collective) judgments promoted to ascertain and declare the nullity of unfair and non-transparent clauses included in b-to-c contracts.
Il d. legisl. 7 marzo 2023, n. 26, al fine di dare attuazione alla direttiva UE 2019/2161, ha modificato l’art. 37-bis del codice del consumo, introducendo nel diritto italiano un sistema di public enforcement delle disposizioni di recepimento della direttiva 93/13/CEE. Nell’ambito di procedimenti amministrativi attribuiti alla competenza esclusiva dell’Autorità garante della concorrenza e del mercato, quest’ultima potrà adottare, nei confronti dei professionisti che utilizzano condizioni generali di contratto contenenti clausole vessatorie e/o non trasparenti per regolare i rapporti contrattuali che instaurano con consumatori, provvedimenti inibitori, sanzioni amministrative pecuniarie e ulteriori misure ripristinatorie, nonché accettare gli impegni che i professionisti eventualmente si offrano di assumere. Il saggio affronta i molteplici problemi interpretativi ed applicativi suscitati dalla nuova disciplina, indagandone l’impatto sistematico e approfondendo la complessa tematica dei rapporti fra procedimenti amministrativi regolati dal novellato art. 37-bis cod. cons. e i giudizi civili (individuali e collettivi) instaurati per l’accertamento e la declaratoria di nullità delle clausole vessatorie e non trasparenti inserite nei contratti b-to-c
