Dir. 2020/1828/EU, which the Italian Government has been delegated to implement by the recent EU Delegation Act 2021 (Law August 4, 2022, no. 127), harmonises the national provisions of the Member States concerning representative actions which can be brought to seek injunction measure and/oder redress measures for the protection of the collective interests of consumers. After describing its tormented legislative process and critically analyzing its objectives and overall features, the essay deals with some of the most innovative aspects of the regulation contained in this EU directive. Particular attention is paid to the scope of application of such regulation, to the differences it presents with respect to the general regulation of class actions contained in Articles 840-bis ff. of the italian Code of Civil Procedure, to the profiles pertaining to the subjects qualified to bring representative actions for the protection of the collective interests of consumers and to the conditions under wich such actions may be brought. In conducting the relevant analysis, the Author highlights the wide margins of discretion granted to the national legislator for the purposes of implementing the directive and the plurality of difficult choices that the Italian Government will be called upon to make to this end.

Dopo averne ripercorso il tormentato iter legislativo e averne analizzato criticamente gli obiettivi e le caratteristiche complessive, il saggio affronta ed approfondisce alcuni degli aspetti più innovativi della disciplina delle azioni “rappresentative” inibitorie e “risarcitorie” a tutela degli interessi collettivi dei consumatori contenuta nella dir. 2020/1828/UE, che il Governo è stato delegato ad attuare dalla recente Legge di delegazione europea 2021 (l. 4 agosto 2022, num. 127). Particolare attenzione viene prestata all’ambito di applicazione di siffatta disciplina, alle differenze che essa presenta rispetto alla regolamentazione generale delle azioni di classe contenuta negli artt. 840-bis ss. del nostro c.p.c., ai profili attinenti alla legittimazione a promuovere le azioni rappresentative e ai presupposti cui è subordinata la possibilità di esperirle. Nel condurre la relativa analisi, l’Autore evidenzia gli ampi margini di discrezionalità concessi al legislatore nazionale ai fini della attuazione della direttiva e le molteplici, delicate scelte che il nostro Governo sarà chiamato a compiere a tal fine.
