La filosofia ermeneutica del diritto in Italia

The essay takes into consideration some key issues concerning Italian legal hermeneutics. There are ways of approaching the hermeneutical problems that have emerged in legal and legal-philosophical culture. They are united in stressing the central role played by interpretation. Italian legal philosophy has been one of the most important fields of work and development of hermeneutical philosophy as practical philosophy. Legal hermeneutics, making use of some basic concepts of hermeneutical philosophy, investigates the foundations of interpretive activities and their connections with the most prominent and constitutive problems of contemporary law. In this perspective, Italian legal hermeneutics understands law as an interpretive social practice and pays attention to elaborating a theory of law able to adhere to the concreteness of the process of positivization. Furthermore, Italian legal hermeneutics underlines how interpretation assumes a specific importance in the complex reality of cultural pluralism.
