La legge delega di riforma degli strumenti complementari. Note a prima lettura

Abstract: The Italian law for the reform of alternative dispute resolution methods. Notes at first reading. The paper analyzes the legal provisions with which the law of 26 November 2021, n. 206 implements the reform of the complementary dispute resolution methods. The objective of creating an "integrated system of civil justice" is pursued by the reform law through many interventions which, although overall positive, do not always correspond to the indications formulated by the European Commission for the Efficiency of Justice (CEPEJ) precisely in order to promote the widest possible use of alternative methods in EU Countries.

Abstract: Lo scritto analizza le disposizioni con cui la legge 26 novembre 2021, n. 206 attua la riforma degli strumenti complementari di risoluzione delle controversie. L’obbiettivo di creare un “sistema integrato di giustizia” civile viene perseguito dalla legge di riforma attraverso molti interventi che, pur essendo complessivamente positivi, tuttavia non sempre corrispondono alle indicazioni formulate dalla European Commission for the Efficiency of Justice (CEPEJ) proprio al fine di promuovere nei Paesi UE l'utilizzo il più ampio possibile dei metodi alternativi.
