The research explores the legal and institutional settings that contribute to the protection of the EU’s financial interests by means of criminal law. The so-called PIF area represents one of the most significant expressions of the European Union and it is indeed in this area that an unprecedented EU criminal law acquis has been implemented. After a brief retracing of the development of European criminal law in the sector concerned, the research aims at investigating the two main perspectives contributing to the fight against fraud and other illegal activities affecting the EU budget after the entry into force of the Treaty of Lisbon: 1) a normative perspective, enriched by the conferral to the EU of new competences in criminal matters, with relevant implications on the so-called PIF area; 2) a jurisprudential perspective, opened up by the extended competence of the Court of Justice of the EU over the former third pillar policies. Under the first perspective the thesis especially focuses on the proposed regulation on the establishment of a European Public Prosecutor’s Office (EPPO) and on the proposed directive for the protection of the EU financial interests by means of criminal law (PIF directive). As for the second perspective, the analysis concentrates on three preliminary rulings (C 105/14 Taricco; C-574/15 Scialdone; C-310/16 Dzivev) related to Article 325 TFEU, likely to have a strong impact on national legal systems as well as on the constitutional foundations of criminal law obligations in the EU legal order. Finally, the research develops some conclusions on the reciprocal interactions between the two mentioned perspectives, claiming for the need of the prevalence of the first one in order to assure legal certainty.

La ricerca si propone di esaminare il panorama delle iniziative sovranazionali a tutela degli interessi finanziari dell’Unione europea alla luce delle novità introdotte dal Trattato di Lisbona. In particolare, vengono messe in rilievo due diverse prospettive: quella normative e quella giurisprudenziale. Da un lato, la più recente revisione dei Trattati ha consacrato una serie di spazi riservati al legislatore UE in malteria penale, sulla cui base sono state intraprese le iniziative volte all’adozione di una direttiva per la protezione degli interessi finanziari dell’Unione attraverso la legge penale (c.d. direttiva PIF) e di regolamento per l’istituzione della Procura europea (c.d. regolamento EPPO). Dall’altro, la ricerca focalizza l’attenzione su una serie di recenti rinvii pregiudiziali che interrogano l’organo giurisdizionale dell’Unione circa la compatibilità della disciplina nazionale, sostanziale e processuale, con l’art. 325 TFUE. La parte finale dell’elaborato si concentra sulle reciproche relazioni intercorrenti tra le due prospettive richiamate, offrendo lo spunto per svolgere alcune riflessioni conclusive sulle reali prospettive del cammino di integrazione europea nel settore considerato.
