Sicurezza sul lavoro, ambiente e prevenzione: disciplina positiva e dilemmi regolativi

The essay sketches the main lines of Italian health and safety legislation, in light of prevention principle and in ecological perspective. Considering the mutual influence between work and environment and also the recent modification of art. 41 of Constitutional charter, the author proposes the reinforcement, in Legislative Decree 81/2008, of the double protection of health and environment, in both internal and external dimension. The added value could be expressed in terms of strengthening of ex ante protection of workers, people and environment. It could be one of the possible factual participation of labour legislation to the ecological transition.
