The events that took place in the RSAs during the pandemic made visible an alarming cultural and legal matter, concerning the failure to recognize the subjectivity of dependent elderly people, as well as the one related to the insufficient protection of their rights. The contribution intends to investigate two aspects of this complex issue, which are strictly interconnected. Firstly, it focuses on the “confinement” of the elderly in residential care facilities, which takes place also in “ordinary” times. Then, it is proposed to reflect on the meaning the intertwining of capacity, freedom and autonomy may assume for dependent elderly people.

Abstract
The events that took place in the RSAs during the pandemic made visible an alarming cultural and legal matter, concerning the failure to recognize the subjectivity of dependent elderly people, as well as the one related to the insufficient protection of their rights. The contribution intends to investigate two aspects of this complex issue, which are strictly interconnected. Firstly, it focuses on the “confinement” of the elderly in residential care facilities, which takes place also in “ordinary” times. Then, it is proposed to reflect on the meaning the intertwining of capacity, freedom and autonomy may assume for dependent elderly people.File | Dimensione | Formato | |
