Patrimoni in cerca di proprietario. L’evoluzione ottocentesca del beneficio ecclesiastico, in particolare nella scienza giuridica tedesca

The 1917 CIC defined in an innovative way the ecclesiastical benefice as a juridical person (institutum, ens iuridicum), giving it the ownership of the estate (the dos). This article examines the theories that tried to identify the potential owner of church property as a reaction to political, legal and economic changes, mainly in XIX century Germany. By comparing these theories, we can clarify their common issues and the different legal options, as well as the influences of the secular German legal science on the theory adopted by the CIC (so called Institutentheorie).

Il CIC del 1917 definiva in maniera innovativa il beneficio ecclesiastico come persona giuridica (institutum, ens iuridicum), attribuendo ad essa la proprietà del rispettivo patrimonio (la dos). L’articolo approfondisce le teorie che, soprattutto in Germania nel XIX secolo, avevano tentato di individuare il possibile proprietario dei beni ecclesiastici in risposta alle trasformazioni politiche, giuridiche ed economiche. Il confronto consente di chiarire i problemi comuni e le differenti scelte giuridiche, nonché le influenze della scienza giuridica tedesca laica sulla teoria definitivamente accolta dal Codice di diritto canonico (cosiddetta ‘Institutentheorie’).
