The paper analyzes some reforms of the civil justice system adopted with the avowed aim of improving Italy's placement in the Doing Business reports. According to the author, the set of new measures has the effect of discouraging excessively and incongruously the exercise of the right to action and defense, risking to sacrifice the juridical nature of the legal order on the altar of the economy.

Lo scritto analizza alcune riforme del sistema di giustizia civile adottate con l'obiettivo dichiarato di migliorare la posizione dell'Italia nei rapporti Doing Business. Secondo l'autore, l'insieme delle nuove misure ha l'effetto di scoraggiare eccessivamente e incongruentemente l'esercizio del diritto all'azione e alla difesa, rischiando di sacrificare la giuridicità dell'ordinamento sull'altare dell'economia.
