Crisi della fattispecie e «nullum crimen» [Crisis of the Legal Provision and «Nullum Crimen]

The Author proposes some variations on the issue of the crisis of legal provision, with regard to the effects produced by the general clauses or legal standards on the accessibility and decipherability of the criminal law, as well as on the calculability of the consequences of its violation, taking into consideration the evolution of the supranational jurisprudence and that of the Constitutional Court.

L'autore propone alcune variazioni sulla questione della crisi delle disposizioni giuridiche, per quanto riguarda gli effetti prodotti dalle clausole generali o dalle norme giuridiche sull'accessibilità e la decifrabilità del diritto penale, nonché sulla calcolabilità delle conseguenze della sua violazione, tenendo conto dell'evoluzione della giurisprudenza sovranazionale e di quella della Corte costituzionale.
