The essay analyses constitutional problems raised, first, by crimi-nological reformism of the 1920s, focusing on drafts or laws and, then,by the claim of an authoritarian criminal law formulated by Nazi juristsin 1933. After Dahm’s and Schaffstein’s manifesto, the reaction of manycriminal law scholars, included some reformers such as Grünhut andRadbruch, reveals how the scientific debate was shifting from thestruggle between different opinions regarding criminal law theories intoa constitutional level grounded on a radical rethinking of the state, itsfoundations and purposes. A comparison between some points ofItalian Fascist criminal law and Nazi reforms and theories shows thepeculiarity of the German totalitarian penal system and its radicaldiscontinuity with the liberal paradigm.
