The paper traces the peculiarities of the presence of vague terms such as general clauses in the context of criminal law, also highlighting, at the end, the negative consequences that their renunciation would possibly produce in terms of apprehensibility of the legislator’s message. The author first explores the effects of the general clauses on the different articulations of the nullum crimen (sine lege et sine culpa), both in its national-constitutional and conventional (ECHR) dimension. Secondly, he distinguishes the clauses contained in legal provisions from those contained in judicial decisions. Thirdly, he proposes a quadripartite classification of the general clauses typical of the criminal law context: meta-juridical clauses, intra-juridical clauses, analogical clauses and clauses of supplementary incrimination (such as those of joint liability/conspiracy, attempt to commit a crime and omissive causation). For each typological group, the specific issues emerging in the concrete interpretation of the clauses are verified through the examination of exemplificative cases.
Il lavoro ripercorre le peculiarità della presenza di formule vaghe come le clausole generali nel contesto del diritto penale, evidenziando alla fine anche le conseguenze negative della eventuale rinuncia alle stesse in termini di inafferrabilità del messaggio del legislatore. L’autore esplora in primo luogo gli effetti delle clausole generali sulle diverse articolazioni del nullum crimen (sine lege et sine culpa), sia nella sua dimensione costituzionale interna che in quella euroconvenzionale. In secondo luogo distingue le clausole contenute in disposizioni normative da quelle contenute in decisioni giudiziali. In terzo luogo propone una classificazione quadripartita delle clausole generali proprie del contesto penalistico (clausole metagiuridiche, intragiuridiche da rinvio, analogiche, di incriminazione suppletiva). Per ogni gruppo tipologico, le specifiche questioni emergenti nella concreta gestione interpretativa delle diverse clausole sono verificate alla luce di esempi emblematici.
