La proprietà contendibile delle reti gas: effetti della Sentenza TAR Lombardia 2018-03-15. Analisi e alcuni suggerimenti

In this short Paper, we analyse the effects of recent judgment - TAR Lombardia 733/2017 – on the liberalisation process of Gas Distribution market in Italy, strongly based on a very important innovation: contestability of asset’s property. Values of gas grids and plants are became the topical question for slow down, if not stopping at all, liberalisation of service and privatisation of as- sets. Such “news” is complicating a Reform already in itself very hard to implement. We try to emphasize both the underline industrial effect and, in particular, financial effects (public and private ones). We then try to suggest some proposal for both Public Regulator and Municipalities.
