After a short description of the phenomenon of trade unions’ bilateral funds, in an evolutionary perspective, the A. describes three types of funds in the area of social protection for the unemployed: autonomous funds, institutionalised funds and the funds provided by Fornero Act and Jobs Act. Then the A. analyses trade unions’ bilateral short time earning funds of decree no. 148/2015. Finally, it is questioned the relationship between these funds and the Constitutional Chart. More specifically, the three types of funds are evaluated in the light of art. 38, 3 (par. 2), 4 and 35 of the Italian Constitution. In particular, it is analysed whether or not trade unions’ bilateral short time earning funds succeed in substituting the coverage of public social protection.
