This Ph.D. thesis is an attempt to verify, throughout the examination of the constitutional freedom of scientific research, the performance of some of the key legal concepts of constitutionalism and to figure out how the modern constitutions react in front of the impact of new technologies. Using italian, european, foreign and international case law, the thesis will attempt to address three fundamental issues. The first is what constitutional protection we have for freedom of scientific research and who can claim that protection. The second is how government can promote the scientific research without abridge the freedom of the scientist. The third is what kind of regulation fit best to the new technologies
