This contribution examines whether the European Convention on Human Rights and the case law of the European Court of Human Rights offer any indication as to the appropriateness of any specific definition of organised crime to be adopted in the EU legal order. It analyses the case law relating to positive obligations in the fight against organised crime; and to the guarantees for suspects/convicted of participation in organised crime, notably those relating to Article 7 ECHR.
