Osservazioni sulla domanda di accertamento incidentale di questioni pregiudiziali

Remarks on the demand of judgment on preliminary question. The article defines the terms within which during the civil proceedings must be proposed the demand of judgment on preliminary questions, by analyzing separately the cases in which the demand is made by the plaintiff or defendant and, within individual positions, with reference to cases in which the prejudicial relationship is connected by dependence or legal incompatibility with the legal relationship object of claim. The study identify also the procedural activities required in cases in which the preliminary question is the result of the initiative taken ex officio by the judge.

L’articolo individua i termini entro cui nel processo civile deve essere proposta la domanda di accertamento incidentale di questioni pregiudiziali, analizzando distintamente le ipotesi in cui la domanda sia proposta dall’attore o dal convenuto e, all’interno delle singole posizioni, considera se il rapporto pregiudiziale si pone in connessione di pregiudizialità dipendenza o di incompatibilità giuridica con quello oggetto della domanda introduttiva. Individua altresì le attività processuali richieste nelle ipotesi in cui la questione pregiudiziale emerga a seguito di iniziativa assunta ex officio dal giudice.
