After a brief overview of the basic principles of the law of occupation, the A. examines the main objections commonly raised in order to deny the application of this legal regime in the West Bank and in the Gaza Strip. The A. then analyses the impact of the qualification of the Gaza Strip as occupied territory on the operation Cast Lead, launched by Israel in December 2008. The A. finally considers that the measures adopted by Israel in the West Bank and in the Gaza Strip have not always been consistent with the law of occupation and that their overall impact might undermine the right of the Palestinian people to self- determination.
