Through an inadmissibility decision the Constitutional Court unduly suggests to the legislator remedies to the problem of the unreasonable duration of judgments resulting from the necessity to repeat depositions in the case of judge's replacement. Such remedies reveal a reductive conception of the principle ofimmediacy and arbitrarily sacrifice the rights of the defendant for reasons which mainly depend on State's inefficiencies in the organisation of justice.
Con una sentenza di inammissibilità la Corte costituzionale suggerisce indebitamente al legislatore rimedi al problema della dilatazione dei tempi processuali dovuta alla necessità di esaminare nuovamente i testimoni in dibattimento in caso di sostituzione del giudice. Tali rimedi riflettono una concezione riduttiva del principio di immediatezza e tendono a sacrificare arbitrariamente le garanzie dell'imputato per ragioni che dipendono in prevalenza da inefficienze dello Stato nell'organizzazione della giustizia.
