Art 7 of Law Decree No 1 of 24 January 2012, subsequently enshrined in Law No 27 of 24 March 2012, has broadened the scope of application of the law regulating commercial practices of businesses towards consumers set out in the provisions of Art 18 and following of the Italian Consumer Code; it achieves this by expressly including “unfair commercial practices between businesses and microenterprises”. The essay attempts to investigate the meaning, scope and consequences of this significant innovation within the framework of European private law and its evolution.
