The paper analyses the real and apparent additions contained in the verdict of the Court of Cassation - joint sittings of all divisions no. 16379 of 17 July 2014 - on the recognition of ecclesiastical annulment verdicts. Starting from the jurisprudential contrast that has marked the decisions of the Supreme Court over the past twenty years, the study highlights how the Court of Cassation in an enlarged sitting in the verdict mentioned, reinterprets the conventions and asserts the end of the reserve of jurisdiction in favour of the ecclesiastical courts, on the basis of a different interpretation of the principle of laity, identified as the bulwark and guarantee of the independent sovereignty of the Republic. A critical comment is reserved for the interpretation offered by the Supreme Court of the over-three year duration of the marriage as a principle of internal public order and however “only raised by one party.

Il contributo analizza le novità vere ed apparenti contenute nella sentenza della Corte di Cassazione a Sezioni Unite n. 16379 del 17 luglio 2014 in tema di delibazione delle sentenze ecclesiastiche di nullità. Partendo dal contrasto giurisprudenziale che ha caratterizzato nell'ultimo ventennio le decisioni della Suprema Corte, lo studio evidenzia come la Corte di Cassazione a composizione allargata nella sentenza in commento, reinterpreti le norme pattizie ed affermi la fine della riserva di giurisdizione a favore dei tribunali ecclesiastici, basandosi su di una diversa lettura del principio di laicità, individuato come baluardo e garanzia della sovranità indipendente della Repubblica. Un commento critico è riservato all'interpretazione offerta dalla Suprema Corte della durata ultratriennale del matrimonio-rapporto quale principio di ordine pubblico interno e tuttavia "rilevabile solo ad istanza di parte".
